Kenya and the International Criminal Court

The Institute for Security Studies (ISS) in Pretoria published on 9 September 2013 a common sense piece titled "Kenya and the ICC: A Tale of Three Mistakes and the Cruellest Gamble" by Sivu Maqungo, senior research consultant at ISS.

According to Maqungo, the first mistake was the decision by the Kenyan parliament to turn down the Waki Commission recommendation to create a local tribunal to investigate and prosecute persons suspected of criminal conduct.  The second mistake was the recommendation by the Waki Commission to then submit the matter to the International Criminal Court (ICC).  The third mistake was the decision by the Kenyan parliament calling on the government of Kenya to withdraw from the ICC.
